This issue seems to be backported from mainline to 2.6.22.18. see changelog:

2.6.22.18 was released today. It seems that there is a vs-patch 
(released today)
available for this version - see here:

http://ftp.linux-vserver.org/pub/kernel/vs2.2/patch-2.6.22.18-vs2.2.0.6.diff

Can it be that you are using kernel 2.6.22.16 or 2.6.22.17 with vs-patch
2.2.0.6?
