If you patch against linux-2.6.38.4 from kernel.org the patch should 
apply cleanly. I am not sure about 2.6.38.8 but you might give it a try.

And this patch applied cleanly to the stock Slackware 13.37 2.6.37.6 kernel? I'm currently looking for the best patch to apply to the stock Slackware 13.37 kernel... Or should I forego Vserver+gresec altogether and just try the normal Vserver patch?

If you patch against linux-2.6.38.4 from kernel.org the patch should apply cleanly. I am not sure about 2.6.38.8 but you might give it a try.
